本《協(xié)議》是用戶與360之間關(guān)于用戶下載、安裝、使用、復(fù)制隨附本《協(xié)議》的快剪輯（以下簡(jiǎn)稱“軟件”）的法律協(xié)議。

1. 權(quán)利聲明

本軟件是一款基于FFmpeg的LGPL許可協(xié)議下的應(yīng)用開發(fā)。360依據(jù)LGPL授權(quán)進(jìn)行使用、開發(fā)、傳播，并遵守LGPL許可協(xié)議,對(duì)需要開源的部分會(huì)進(jìn)行源代碼開放。本軟件使用之開源軟件的知識(shí)產(chǎn)權(quán)由開源軟件提供者所有。360對(duì)開源軟件的修改及增附部分以及與本軟件相關(guān)的所有信息內(nèi)容，包括但不限于：文字表述及其組合、圖標(biāo)、圖飾、圖像、圖表、色彩、界面設(shè)計(jì)、版面框架、有關(guān)數(shù)據(jù)、附加程序、印刷材料或電子文檔等享有知識(shí)產(chǎn)權(quán)，受著作權(quán)法和國(guó)際著作權(quán)條約以及其他知識(shí)產(chǎn)權(quán)法律法規(guī)的保護(hù)。

本軟件僅向用戶提供視頻錄制、剪輯、編碼與發(fā)布到相關(guān)網(wǎng)站的技術(shù)服務(wù)，并不向用戶提供任何音視頻與圖片等內(nèi)容。用戶使用本軟件所生產(chǎn)的視頻內(nèi)容均由用戶自行選擇，所產(chǎn)生的一切法律問(wèn)題及后果均由用戶自行承擔(dān)，與快剪輯無(wú)關(guān)。

2. 許可范圍

2.1 下載、安裝和使用：本軟件為免費(fèi)軟件，用戶可以非商業(yè)性、無(wú)限制數(shù)量地下載、安裝及使用本軟件。

2.2 復(fù)制、分發(fā)和傳播：用戶可以非商業(yè)性、無(wú)限制數(shù)量地復(fù)制、分發(fā)和傳播本軟件產(chǎn)品。但必須保證每一份復(fù)制、分發(fā)和傳播的拷貝都是完整和真實(shí)的，包括所有有關(guān)本軟件產(chǎn)品的軟件、電子文檔、版權(quán)和商標(biāo)，亦包括本協(xié)議。

3. 權(quán)利限制

3.1禁止反向工程、反向編譯和反向匯編：用戶不得對(duì)本軟件產(chǎn)品進(jìn)行反向工程（Reverse Engineer）、反向編譯（Decompile）或反向匯編（Disassemble），同時(shí)不得改動(dòng)編譯程序文件內(nèi)部的任何資源。除法律、法規(guī)明文規(guī)定允許上述活動(dòng)外，用戶必須遵守此協(xié)議限制。

3.2 組件分割：本軟件產(chǎn)品是作為一個(gè)單一產(chǎn)品而被授予許可使用，用戶不得將各個(gè)部分分開用于任何目的。

3.3 個(gè)別授權(quán)：如需進(jìn)行商業(yè)性的銷售、復(fù)制、分發(fā)，包括但不限于軟件銷售、預(yù)裝、捆綁等，必須獲得360的書面授權(quán)和許可。

4. 用戶使用須知

4.1軟件功能：

本軟件是提供用戶錄制小視頻及剪輯等功能的技術(shù)服務(wù)工具。包含錄制小視頻功能、剪輯功能、導(dǎo)出功能、分享發(fā)布功能、其他功能。

4.1.1 錄制小視頻
提供用戶錄制屏幕上顯示的圖像內(nèi)容并保存為視頻文件的技術(shù)服務(wù)。

4.1.2 剪輯功能
1 素材剪輯：其提供針對(duì)單個(gè)視頻或圖片素材的剪輯和裁剪畫面的功能
2 視頻剪輯：其提供針對(duì)多個(gè)素材在時(shí)間線上的位置調(diào)整、持續(xù)時(shí)間調(diào)整和切分等功能

4.1.3.導(dǎo)出功能
本軟件提供基于FFmpeg的視頻編碼功能，并支持設(shè)定碼率、分辨率等參數(shù)

4.1.4分享發(fā)布功能
在分享過(guò)程中，為提高用戶體驗(yàn)與發(fā)布效率，本軟件為用戶提供了綁定并一鍵分享到多個(gè)視頻平臺(tái)的技術(shù)服務(wù)。如用戶不接受該功能，請(qǐng)勿復(fù)制、下載、安裝或以其他方式使用本軟件。

4.1.5 其他功能
1 添加本地素材：支持添加本地多媒體素材文件到編輯器中，并最終合并導(dǎo)出為視頻文件
2 添加網(wǎng)絡(luò)素材：支持使用關(guān)鍵字通過(guò)搜索引擎獲取網(wǎng)絡(luò)視頻播放地址和圖片查看地址的功能，同時(shí)也支持直接粘貼地址并用360安全瀏覽器打開的功能。
3 項(xiàng)目管理：支持新建、刪除、重新編輯項(xiàng)目文件和查看項(xiàng)目發(fā)布狀態(tài)的功能

4.2 本軟件僅適用于windows XP/Vista/Win7/win10操作系統(tǒng)，為保證用戶的使用體驗(yàn)，建議用戶使用擁有4G以上內(nèi)存和中高端CPU、顯卡的計(jì)算機(jī)運(yùn)行本軟件。如果用戶在安裝本軟件后因任何原因欲放棄使用，可從Windows控制面板刪除本軟件。因刪除產(chǎn)生的一切后果由用戶承擔(dān)。

4.3 本軟件由360提供產(chǎn)品支持。

4.4 本軟件作為工具，僅提供技術(shù)服務(wù)，用于用戶個(gè)人的學(xué)習(xí)及娛樂(lè)。其涉及的視頻內(nèi)容，圖像，多媒體素材，均由用戶自行選擇，與本軟件無(wú)關(guān)。

4.5 軟件的修改和升級(jí)： 360保留隨時(shí)為用戶提供本軟件的修改、升級(jí)版本的權(quán)利。

4.6 本軟件不含有任何旨在破壞用戶數(shù)據(jù)和獲取用戶隱私信息的惡意代碼，不含有任何監(jiān)控、監(jiān)視用戶計(jì)算機(jī)的功能代碼，不會(huì)收集用戶個(gè)人文件、文檔等信息，不會(huì)泄漏用戶隱私

4.7 用戶應(yīng)在遵守法律及本協(xié)議的前提下使用本軟件。用戶無(wú)權(quán)實(shí)施包括但不限于下列行為：

4.7.1 刪除或者改變本軟件上的所有權(quán)利管理電子信息；

4.7.2 故意避開或者破壞著作權(quán)人為保護(hù)本軟件著作權(quán)而采取的技術(shù)措施；

4.7.3 利用本軟件誤導(dǎo)、欺騙他人;

4.7.4 違反國(guó)家規(guī)定，對(duì)計(jì)算機(jī)信息系統(tǒng)功能進(jìn)行刪除、修改、增加、干擾，造成計(jì)算機(jī)信息系統(tǒng)不能正常運(yùn)行；

4.7.5 未經(jīng)允許，進(jìn)入計(jì)算機(jī)信息網(wǎng)絡(luò)或者使用計(jì)算機(jī)信息網(wǎng)絡(luò)資源；

4.7.6 未經(jīng)允許，對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)功能進(jìn)行刪除、修改或者增加的；

4.7.7 未經(jīng)允許，對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)中存儲(chǔ)、處理或者傳輸?shù)臄?shù)據(jù)和應(yīng)用程序進(jìn)行刪除、修改或者增加；

4.7.8 破壞本軟件系統(tǒng)或網(wǎng)站的正常運(yùn)行，故意傳播計(jì)算機(jī)病毒等破壞性程序；

4.7.9 其他任何危害計(jì)算機(jī)信息網(wǎng)絡(luò)安全的行為。

4.8 對(duì)于從非360指定站點(diǎn)下載的本軟件產(chǎn)品以及從非360發(fā)行的介質(zhì)上獲得的本軟件產(chǎn)品， 360無(wú)法保證該軟件是否感染計(jì)算機(jī)病毒、是否隱藏有偽裝的木馬程序或者黑客軟件，使用此類軟件，將可能導(dǎo)致不可預(yù)測(cè)的風(fēng)險(xiǎn)，建議用戶不要輕易下載、安裝、使用， 360不承擔(dān)任何由此產(chǎn)生的一切法律責(zé)任。

4.9 隱私權(quán)保護(hù)

4.9.1 360承諾遵守《 360 用戶隱私保護(hù)白皮書》以及適用法律的規(guī)定。

4.9.2 賬號(hào)綁定：在帳號(hào)綁定過(guò)程中360不會(huì)收集任何用戶所綁定的其他視頻平臺(tái)的帳號(hào)密碼等信息。

4.9.3 安裝卸載：當(dāng)用戶安裝快剪輯，或者卸載快剪輯時(shí)，快剪輯會(huì)發(fā)送您安裝或者卸載的軟件號(hào)和系統(tǒng)信息給360，用于統(tǒng)計(jì)不同版本的卸載率，幫助360發(fā)現(xiàn)問(wèn)題；卸載時(shí)還會(huì)讓用戶填寫卸載原因，如果用戶填寫了，相應(yīng)信息也會(huì)收集到360的服務(wù)器，用于改進(jìn)360的產(chǎn)品。

4.9.4程序錯(cuò)誤日志上報(bào)：當(dāng)用戶在使用本軟件時(shí)出現(xiàn)崩潰或者其他異常，如果用戶參加了用戶體驗(yàn)改進(jìn)計(jì)劃，本軟件會(huì)將崩潰報(bào)告發(fā)送給360的服務(wù)器。本軟件會(huì)避免發(fā)送用戶個(gè)人身份識(shí)別信息，但是為了幫助360診斷快剪輯的問(wèn)題，發(fā)送給360服務(wù)器的崩潰報(bào)告會(huì)包含有快剪輯進(jìn)程崩潰的Dump文件和快剪輯崩潰進(jìn)程的相關(guān)參數(shù)、以及快剪輯所在運(yùn)行系統(tǒng)和環(huán)境相關(guān)的信息。

4.9.5 使用：當(dāng)用戶使用本軟件時(shí)，如果用戶參加了用戶體驗(yàn)改進(jìn)計(jì)劃，本軟件會(huì)報(bào)告部分使用信息到360的服務(wù)器。本軟件會(huì)避免發(fā)送用戶個(gè)人身份識(shí)別信息，但是為了幫助360改善用戶體驗(yàn)，為用戶提供更好的服務(wù)，發(fā)送給360服務(wù)器的使用信息會(huì)包括用戶的使用次數(shù)、時(shí)長(zhǎng)、常用設(shè)置參數(shù)，以及快剪輯所在運(yùn)行系統(tǒng)和環(huán)境相關(guān)的信息。

4.9.6 360制定了嚴(yán)格的用戶上傳信息處理規(guī)則和安全保護(hù)措施來(lái)確保不超越目的和范圍收集用戶信息，確保用戶上傳信息的安全，確保用戶上傳信息不被濫用。除征得用戶明確同意和法律明確規(guī)定外， 360不會(huì)向任何第三方提供用戶上傳文件及信息。

4.9.7 360制定了以下四項(xiàng)隱私權(quán)保護(hù)原則，指導(dǎo)360如何來(lái)處理產(chǎn)品中涉及到用戶隱私權(quán)和用戶信息等方面的問(wèn)題：
（1）利用我們收集的信息為用戶提供有價(jià)值的產(chǎn)品和服務(wù)。
（2）開發(fā)符合隱私權(quán)標(biāo)準(zhǔn)和隱私權(quán)慣例的產(chǎn)品。
（3）將個(gè)人信息的收集透明化，并由權(quán)威第三方監(jiān)督。
（4）盡最大的努力保護(hù)我們掌握的信息。
